found in the bathroom of a plane. the flight took off from bangkok, landed safely less than three hours ago. thai airways says that someone scrawled a message on the lavatory mirror saying there was a bomb on the plane. the threat was in english. the note apparently contained poor grammar and passengers have gotten off that plane. authorities are interviewing them now along with the crew. luggage is also being screened. also in the news tonight three east bay schools in danger of shutting down are looking to their own city for help again tonight. the schools are grant and olinda elementaries and kennedy high all in richmond. the campuses serve more than 1,600 students. robert lyles shows us the classmates warrant closures could lead to violence. >> reporter: we are live outside richmond city council chambers and inside there have been more than 40 speakers who spent the past two hours offering commentary as to why all three of those schools

should remain open. now the richmond city council must figure out or at least find 1 1/2 million dollars to keep those schools open for the next two years. now one city councilman tells us tonight he and the board are feeling financially bullied, but a pending election just may assure all three of those schools stay open. closing kennedy high school is more like a lecture in history. >> there's been generations pass through this school. >> reporter: a seminar on psychology. >> it's like a home wrecker, like tearing down schools. >> reporter: and a term paper on how to encourage social unrest. >> why don't they do some other school. therefore, you combine those two, it would be like massive destruction to the school. >> reporter: but for a school with lagging enrollment it seems the thing for the school board. >> there seem to be potential possibilities to keep all three of the schools open. >> reporter: it was in

february, 2009 that the west contra costa school board voted 4-1 to shutter the three schools, but now the board president is saying bean counters forced that vote. >> and one of those standard recommendations is to make sure that you close your smallest schools. essentially that was the recommendation that was brought before the board. >> if this is not a matter to argue, this is a matter to agree. >> reporter: but it seems the vote to get $1.5 million from the city tonight to keep the schools open through spring 2012 is less of a lesson in civics and more of a lesson on political expediency. you see, board members are up for reelection and at least one current city councilman is running to replace the mayor. so even though the council is angry at the school board for what they call fiscal mismanagement -- >> from that perspective i think we have been kneelinged. >> reporter: you can't be re' -- neglected. >> reporter: you can't be reelected on a platform that

you shut down schools. what's that mean for the three richmond schools? >> it's going to be passed unanimously. >> reporter: richmond is not the only city to intervene in keeping a school open. san pablo also paid to keep one of its schools open. the difference here in richmond we're told the money is likely going to come from general fund which means the city must decide whether they'll continue to fix the roads and pay for the libraries compared to keeping those schools open. there was a windfall recently with a settlement of $114 million with chevron. that could also be used, but right now there is no final vote by the city council. so no final decision as to exactly where that 1 1/2 million dollars will come from. >> keep us updated, robert lyles in richmond. thanks. new complaints tonight over pg&e's smart meters and this one has nothing at all to do with your utility bill. several people are reporting the smart meters are interfering with electronic household gadgets, devices such as cordless phones, crib monitors and wireless headsets.

they pop and crackle and give off static. the problem apparently happens when the smart meter electronically transmits information back to pg&e. also affected security systems and remotely controlled garage doors. factors come into this." 9:47 >> there are some things we can do and again that's why we encourage customers to reach out to us, but certainly could have to do with location of the devices if there's a chance to move a device, age of device. there's a lot of factors that do come into this. >> in a report written to the california public utilities commission in 2009 pg&e said that it had discovered cases of smart meter interference with other electronics and it was working on a solution. meanwhile the state tests televisions and refrigerators all the time for energy usage, but hot tubs? consumers are paying 13 cents a month extra on electricity bills for california to buy appliances including brand-new hot tubs directly from the manufacturers. they are tested to see if they

comply with energy efficiency standards and then sold at auction at a fraction of the cost. program. but it's providing over dollars a year i >> we're not getting the best bang for our buck when money gets spent this way. >> consumers are paying 13 intents cent a month for the testing for the standards program, but it's providing over a billion dollars a year on savings on utility bills. >> yet consumers question why the state doesn't follow the feds who have found a way to do protect testing for free. the california energy commission declined an interview for this one. headlines around the bay area tonight, in oak hand a man suspected of shooting a freemont police officer -- oakland a man suspected of shooting a freemont police officer made his appearance this afternoon. he confessed to opening fire on officer todd young last month, one of two plainclothes officers trying to arrest barrientos, a suspected gang member on a warrant. tonight young is in serious but stable condition. barrientos did not enter a plea

we have an update out of richmond tonight with respect to that school board meeting. the western contra costa school district, them have voted to go ahead and fund those two elementary schools, grant and olinda as well as kennedy high school in richmond. the city council decided to kick in more than a million dollars to help fund the schools at least through next spring. we'll have complete details on www.cbs5.com. looking at some state news now, meg whitt map's former rival is now her -- whitman's former rival is now her supporter. state insurance commissioner steve poizner endorsed his fellow republican for governor in a statement released today in which poizner backed the entire california gop ticket. poizner did not offer any

praise for whitman. actually during the primary he accused the former ebay ceo of being a republican in name only. the senate race between carly fiorina and incumbent barbara boxer is getting a little tight. a rasmussen report survey released today puts those candidates in a dead heat giving fiorina 48% of the vote and boxer 47%. the poll has a margin of error of four percentage points, so it's anyone's game now, the survey taken yesterday. the candidates had their first debate last week. starting tomorrow foreign tourists will have to pay appear extra couple of bucks to visit -- an extra couple of bucks to visit the u.s. visitors from 36 countries will have to pay $14 to register through the electronic system for travel authorization. registration is required for travelers using the visa waiver program. part of that money will pay for the program's operating costs, but most of it will go to promoting the u.s. as a tourist
